McCarrick Walks

               The matter of Commonwealth v. Theodore McCarrick, Docket # 2154CR000670, was heard in Dedham District Court at 9 a.m. today, June 29, 2023.

               On February 27, 2023, the defendant, through counsel, had filed a motion to dismiss all pending charges with an accompanying competency report in support of that motion. That report was impounded by Judge Michael J. Pomarole.

Assistant District Attorney Lisa Beatty told Judge Pomarole that the Commonwealth would hire an expert to assess competency. That expert flew to Missouri to conduct the evaluation.  On April 20, 2023, the Court allowed the Commonwealth’s motion for that expert to obtain the defendant’s medical records to supplement the in-person examination.

The Commonwealth’s examiner returned the competency report to Dedham District Court this week. In court this morning, it was put into the record that the conclusion of the Commonwealth’s examiner concurred that Theodore McCarrick is not currently competent to stand trial. The report itself was not made public.

The report is lengthy and is being evaluated. The court set a date of August 30, 2023 for a hearing on the available reports, which may include testimony from the Commonwealth’s examiner.
